Student Visa Question

Q. My son is out of status for 15 years. Can he get a graduate student visa?

A. he probably cannot get a student status. The INS rarely grants student status to people who have been in the US unlawfully for so long. However, it may not be too late for him to get permanent residence. Though he has been here unlawfully and the law bars resident to people unlawfully in the US for more than 180 days, you do not count time while the applicant is not yet 18. He can apply for permanent resident if you are US citizen.
