Fraudulent Application 

Q. Though my sister was married, my mother petitioned for her as her unmarried daughter. My sister could not find her husband to divorce him. When she went to her immigrant visa interview, she learned that the consul had discovered her marriage. The consular officer showed her the marriage certificate. Is there any chance my sister may ever get her visa?

A. Whoops! The consul caught your sister making a fraudulent visa application. To get an immigrant visa, she'll now have to apply to the INS for a fraud waiver, and she'll have to prove that her mother will suffer extreme hardship if the consul doesn't grant her the visa. If your mother is a permanent resident, she can't petition again for your sister unless she becomes a US citizen, or your sister get divorced.
