Fiancé in US

Q. My fiancé is in US with a visitor's visa. I am a US citizen. Is there an "engagement visa" so that he can stay here until he marries me?

A. The law provides for "engagement visa" (K-1 finance visa). But your husband-to-be would have to return home to get it. He cannot change from visitor to fiancé status. However, once you marry, he can immediately apply for the green card, work permission and travel permission. That is true even if he were to overstay on his visitor's visa. If he overstays, he would be here illegally, but he could still apply to get his residence here
