F-1 Visa Expired

Q. My F-1 visa expired. Can I go to Canada to get a new one? I came here with an F-1 visa. My visa expired but I am still in lawful status. I'm worried that if I go home to visit my parents, the US consul won't give me a visa to return.

A. You can apply for a new F-1 visa in Canada. If the consul there denies the visa, you can reenter within 30 days using your I-94 with the Duration of Status or D/S notation. You'll need to call ahead for an appointment. You can get consulate number from the US State Department visa services' web site.

Here is what you should take to your interview: a newly issued form I-20, Certificate of eligibility for Nonimmigrant (F-1) Student Status, your college transcripts, proof of attendance, and the proof of financial resources (if you use an affidavit of support it should have been signed within the last six months). Make sure that your adviser signs page 4 of form I-20, authorizing your travel. Make sure that Canadian officials do not take your I-94 form by mistake as you enter Canada. You'll need the I-94 to reenter the U.S.
