A Citizen's Petition

Q. My U.S. citizen son petitioned for me. 0nce I get permanent residence, will my wife and my minor children get residence automatically as well?

A. Your wife and children WILL NOT get automatic (derivative) permanent residence when the INS approves your case. Your wife can get residence through your son if she is his natural mother or his stepmother Or, you can petition for your wife, but her case will go faster if your son is the petitioner. As for your children, you should petition for them as soon as you get your residence. They can expect to wait several years before a U.S. consul calls them for an immigrant visa interview. Unlike "preference" category applicants, the families of immediate relatives don't qualify for derivative residence.
