Q. Can an undocumented child attend school and get Medicaid without the INS finding out?

A. Undocumented children have the same right to public education as US citizens and permanent residents. That right is guaranteed by the US Constitution. They are also eligible for Medicaid Emergency health care, and immunization programs. They qualify for school breakfast and lunch programs. Getting these benefits is very unlikely to lead to INS enforcement.
